{"id":11646,"date":"2026-04-07T16:17:36","date_gmt":"2026-04-07T21:17:36","guid":{"rendered":"https:\/\/sza.pe\/?p=11646"},"modified":"2026-04-07T16:17:43","modified_gmt":"2026-04-07T21:17:43","slug":"se-elimina-norma-que-prohibia-tercerizar-actividades-del-nucleo-del-negocio","status":"publish","type":"post","link":"https:\/\/sza.pe\/en\/se-elimina-norma-que-prohibia-tercerizar-actividades-del-nucleo-del-negocio\/","title":{"rendered":"Se elimina norma que prohib\u00eda tercerizar actividades del n\u00facleo del negocio"},"content":{"rendered":"<div data-elementor-type=\"wp-post\" data-elementor-id=\"11646\" class=\"elementor elementor-11646\" data-elementor-post-type=\"post\">\n\t\t\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-7d08a412 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"7d08a412\" data-element_type=\"section\" data-e-type=\"section\">\r\n\t\t\r\n\t\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\r\n\t\t\t\t\t\t\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-5a02fc8d\" data-id=\"5a02fc8d\" data-element_type=\"column\" data-e-type=\"column\">\r\n\t\t\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\r\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-1f9bb30b elementor-widget elementor-widget-text-editor\" data-id=\"1f9bb30b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400; font-size: 16px;\">Con fecha 1\u00ba de abril de 2026, se public\u00f3 la sentencia de la Sala de Derecho Constitucional y Social de la Corte Suprema correspondiente a la Acci\u00f3n Popular N\u00ba 30989-2023- LIMA, por la cual declara NULO el Decreto Supremo N\u00ba 001-2022-TR que prohib\u00eda tercerizar actividades propias del n\u00facleo del negocio.<\/span><\/p><p><span style=\"font-weight: 400; font-size: 16px;\">De esta manera, luego de m\u00e1s de 4 a\u00f1os, queda zanjada de manera definitiva la aplicaci\u00f3n controversial de este Decreto Supremo que infring\u00eda el principio de jerarqu\u00eda normativa, ya que fijaba l\u00edmites que la propia Ley de Tercerizaci\u00f3n de Servicios (Ley N\u00ba 29245), de mayor rango legal, no lo establec\u00eda.\u00a0<\/span><\/p><p><span style=\"font-weight: 400; font-size: 16px;\">Por el contrario, la propia Ley indica que se pueden celebrar contratos con el objeto de que un tercero (empresa tercerizadora) se haga cargo de una parte integral del proceso productivo (dentro del cual se entiende que est\u00e1n inmersas las actividades del n\u00facleo del negocio) de la empresa principal que contrata el servicio.<\/span><\/p><p><span style=\"font-weight: 400; font-size: 16px;\">En ese sentido, el Decreto Supremo N\u00ba 001-2022-TR deviene en ilegal e inconstitucional para la Sala de Derecho Constitucional y Social de la Corte Suprema y sale de nuestro ordenamiento normativo.\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\r\n\t\t\t\t<\/section>\r\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-54c006f elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"54c006f\" data-element_type=\"section\" data-e-type=\"section\">\r\n\t\t\r\n\t\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-no\">\r\n\t\t\t\t\t\t\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-19e4201\" data-id=\"19e4201\" data-element_type=\"column\" data-e-type=\"column\">\r\n\t\t\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\r\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-395960c elementor-widget elementor-widget-text-editor\" data-id=\"395960c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-size: 16px;\"><span style=\"font-weight: 400;\">El Equipo Legal de Salazar &amp; Z\u00fa\u00f1iga Abogados queda a su disposici\u00f3n para cualquier consulta o coordinaci\u00f3n sobre este asunto.
